TERMS

Flathead Valley Web Works is the sole owner of the information collected on this Web site. We only gather information we need to serve you better and will not - without your consent, - sell, share, or rent this information to others in ways different from what is disclosed in this statement except in cases where in good faith we believe that the law requires us to do so, it is necessary to protect Flathead Valley Web Works's rights and/or property, or if circumstances necessitate acting to protect the personal safety of staff or of the public.

All agreed upon proposals require a deposit at inception, deposits are non-refundable after 90 days. Balance of all fees due before final publication to the Internet.  All hosting fees are billed electronically, monthly, quarterly, semi-annually or annually per agreement, in advance on the 1st of the month and are due on the date of invoice. An invoice will be sent to the email address of record. Accounts become past due at 15 days, if your account should go 30 days past due, we shall suspend service of said website. A fee of $50.00 shall be charged to re-establish service.  Our preferred payment method is by credit card, (we can accept Visa, MasterCard, Discover or American Express via PayPal).  All past due accounts shall be assessed a 1 1/2% per month charge of the outstanding balance (18% per year) this proposal shall become a binding contract on both parties upon signing. 

The laws of the state of Montana shall govern disputes that may arise. If the need for legal actions should arise, it is agreed that the prevailing party shall be entitled to collect all fees involve in the action and all fees to collect and enforce the action.

We at Flathead Valley Web Works, strive to ensure our service is the best value in the web market, but understand that from time to time customers will not choose our services,  so we ask that if you choose not to use our service,  please, call and let us know what we could have done better to satisfy your needs so we may better serve you in the future.

ACCEPTABLE USE POLICY

This Acceptable Use Policy document, including the following list of Prohibited Activities, is an integral part of your Hosting Agreement with Flathead Valley Web Works. If you engage in any of the activities prohibited by this AUP document Flathead Valley Web Works may suspend or terminate your account.

Flathead Valley Web Works's Acceptable Use Policy (the "Policy") for Flathead Valley Web Works Services is designed to help protect Flathead Valley Web Works, Flathead Valley Web Works's customers and the Internet community in general from irresponsible or, in some cases, illegal activities. The Policy is a non-exclusive list of the actions prohibited by Flathead Valley Web Works. Flathead Valley Web Works reserves the right to modify the Policy at any time, effective upon posting at http://www.fvww.com/html/legal.html.

Prohibited Uses of Flathead Valley Web Works Systems and Services:

1. Transmission, distribution or storage of any material in violation of any applicable law or regulation is prohibited. This includes, without limitation, material protected by copyright, trademark, trade secret or other intellectual property right used without proper authorization, and material that is obscene, defamatory, constitutes an illegal threat, or violates export control laws.

2. Sending Unsolicited Bulk Email ("UBE", "spam"). The sending of any form of Unsolicited Bulk Email through Flathead Valley Web Works's servers is prohibited. Likewise, the sending of UBE from another service provider advertizing a web site, email address or utilizing any resource hosted on Flathead Valley Web Works's servers, is prohibited. Flathead Valley Web Works accounts or services may not be used to solicit customers from, or collect replies to, messages sent from another Internet Service Provider where those messages violate this Policy or that of the other provider.

3. Running Unconfirmed Mailing Lists. Subscribing email addresses to any mailing list without the express and verifiable permission of the email address owner is prohibited. All mailing lists run by Flathead Valley Web Works customers must be Closed-loop ("Confirmed Opt-in"). The subscription confirmation message received from each address owner must be kept on file for the duration of the existence of the mailing list. Purchasing lists of email addresses from 3rd parties for mailing to from any Flathead Valley Web Works-hosted domain, or referencing any Flathead Valley Web Works account, is prohibited.

4. Advertising, transmitting, or otherwise making available any software, program, product, or service that is designed to violate this AUP or the AUP of any other Internet Service Provider, which includes, but is not limited to, the facilitation of the means to send Unsolicited Bulk Email, initiation of pinging, flooding, mail-bombing, denial of service attacks.

5. Operating an account on behalf of, or in connection with, or reselling any service to, persons or firms listed in the Spamhaus Register of Known Spam Operations (ROKSO) database at www.spamhaus.org.

6. Unauthorized attempts by a user to gain access to any account or computer resource not belonging to that user (e.g., "cracking").

7. Obtaining or attempting to obtain service by any means or device with intent to avoid payment.

8. Unauthorized access, alteration, destruction, or any attempt thereof, of any information of any Flathead Valley Web Works customers or end-users by any means or device.

9. Knowingly engage in any activities designed to harass, or that will cause a denial-of-service (e.g., synchronized number sequence attacks) to any other user whether on the Flathead Valley Web Works network or on another provider's network.

10. Using Flathead Valley Web Works's Services to interfere with the use of the Flathead Valley Web Works network by other customers or authorized users.


Customer Responsibility for Customer's Users

Each Flathead Valley Web Works customer is responsible for the activities of its users and, by accepting service from Flathead Valley Web Works, is agreeing to ensure that its customers/representatives or end-users abide by this Policy. Complaints about customers/representatives or end-users of an Flathead Valley Web Works customer will be forwarded to the Flathead Valley Web Works customer's postmaster for action. If violations of the Flathead Valley Web Works Acceptable Use Policy occur, Flathead Valley Web Works reserves the right to terminate services with or take action to stop the offending customer from violating Flathead Valley Web Works's AUP as Flathead Valley Web Works deems appropriate, without notice.

TERMS

An invoice will be sent to the email address of record, it is your responsibility to advise/inform us if you wish billing and correspondence to go to another email account.

Accounts will be invoiced and due on the 1st of the month and become past due on the 15th, if your account should go 30 days past due, we shall suspend service of said website which will disable your email account/s as well. A fee of $50.00 shall be charged to re-establish service.  Our preferred payment method is by automatic payment using your PayPal account or your bank, (we can accept Visa, MasterCard, Discover or American Express via PayPal).  All past due accounts are subject to a 1 1/2% per month charge of the outstanding balance (18% per year). Terms of Service are subject to change at any time, but you can always find the current Terms posted on our website under “Legal”, this proposal shall become a binding contract on both parties upon signing.

SPAM: Anyone found to be spamming using our server will have his or her account terminated immediately.  Regarding receiving Spam, although we make every attempt to minimize Spam coming to our server we have no control over these companies/individuals who send unsolicited emails.

LEAVING US?:  If you wish to transfer your site to another hosting solution we require a 90 notice of your intent, if notice is less than that you are responsible for payment for 90 days from the date of notice.  We will offer any assistance possible to you in moving your site so that it is as smooth a transition as is possible.
